(the “Official Rules”)
NO PURCHASE NECESSARY TO ENTER OR WIN. SWEEPSTAKES IS OPEN TO RESIDENTS OF THE UNITED STATES. Void in Puerto Rico. Void where prohibited. All federal, state, and local laws and regulations apply. The HOME FOR THE HOLIDAYS Sweepstakes ("Sweepstakes") commences at 12:00 AM (PDT) on October 1, 2002, and ends at 11:59 PM (PST) on December 15, 2002. The Sweepstakes is sponsored solely by Pinnacle Systems, Inc., 280 N. Bernardo Ave., Mountain View, Ca 94043 ("Sponsor"). Eligibility: Sweepstakes is offered only electronically
via the Internet to all natural persons aged How to Enter: You may enter Sweepstakes as follows: Register at http://www.pinnaclesys.com/homefortheholidays by providing all information requested including your full name, mailing address, and email address and click on the "Submit" button; you will then automatically be entered in the Sweepstakes. You may enter the Sweepstakes only once. Entries submitted by one individual via multiple email addresses, and/or mechanically generated entries, may be discarded and may result in total and permanent disqualification from the Sweepstakes. In order to be eligible for the drawing, electronic entries must be received by Sponsor server no later than 11:59 PM (PST) on December 15, 2002. All entries become the exclusive property of Sponsor, and will not be acknowledged or returned. Prizes: Winners should allow six weeks from notification for delivery of prizes. No substitution or transfer of any of the prizes by the winners is permitted, although Sponsor reserves the right to substitute a prize of equal or greater monetary value to the prizes if for any reason any prize cannot be awarded as contemplated in these Official Rules. Selection of Winners: One grand-prize winner, 6 second-prize winners, and 7 third-prize winners will be selected by random drawing from all eligible entries received, to be held on or about December 20, 2002. Odds of winning will be determined by the number of eligible entries received. Winners will be notified by email within 10 business days of the drawing. Winners will have 10 business days from notification to accept the prize by email to “promotions@pinnaclesys.com". Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winners. Each winner will be required to sign and return a release of liability, declaration of eligibility, and, where lawful, a publicity consent agreement, all within 10 business days of acknowledged notification. By accepting and/or using any prize, winner agrees to the use of winner's name, voice, and/or likeness for the purpose of advertising, trade, or promotion of Sponsor without further compensation, unless prohibited by law. If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the completed and executed declaration and releases as required, prize may be forfeited at Sponsor’s discretion and an alternate winner will be selected. Taxes: ALL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF THE PRIZES ARE THE SOLE RESPONSIBILITY OF EACH WINNER. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account submitted. Entries will be declared made by the authorized account holder of the email address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Conditions: By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. The Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor’s reasonable suspicion, tampers with Sponsor’s site, the entry process, intentionally submits more than a single entry, violates these Official Rules, or acts in an unsportsmanlike or disruptive manner. Sponsor, agents, and representatives of Sponsor, their affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, or other technical problem corrupts the administration, security, or proper play of the Sweepstakes. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE SWEEPSTAKES. BY PARTICIPATING IN THE SWEEPSTAKES, EACH PARTICIPANT AGREES TO RELEASE AND HOLD SPONSOR AND THE EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, REPRESENTATIVES OF SPONSOR, THEIR AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION, AND FULFILLMENT AGENCIES, AND LEGAL ADVISORS, HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND IN CONNECTION WITH THE SWEEPSTAKES OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY. Privacy and Use of Information: Sponsor collects personal information from you when you enter the Sweepstakes. Sponsor reserves the right to use and transfer to third parties any and all information related to the Sweepstakes, including information obtained through the Sweepstakes, for marketing purposes or any other purpose, unless prohibited by law. Governing Law: The Sweepstakes and the rights and obligations of Sponsor and participants will be governed and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the state of California, Santa Clara county. The parties consent to the jurisdiction of the state courts of California and federal court located within such state and county with respect to any action, dispute or other matter pertaining to or arising out of these Sweepstakes.
